WR Design and Cut Inc. (Sojourn Overland) Limited Warranty
Thank you for your recent purchase of a Sojourn Overland trailer. The purpose of this document is to explain your LIMITED WARRANTY and the process for initiating warranty claims. We go to great lengths to ensure quality in our trailers and hope your experience with our company is both satisfying and rewarding.
SOJOURN OVERLAND LIMITED WARRANTY
Subject to the terms and conditions set forth herein, SOJOURN OVERLAND (hereinafter referred to as the “Manufacturer”, “SOJOURN OVERLAND”), warrants as follows with respect to the recreational trailer to which will be referred to as the “Trailer”:
Sojourn Overland warrants to the original consumer purchaser that the trailer produced by Sojourn Overland will be free from defects in material and workmanship for a period of one and two years, depending upon the trailer model and component, except as herein limited, from the date of the first retail purchase, provided all stated conditions and exclusions are satisfied. This warranty is limited to the first retail purchaser and it is not transferrable or applicable to rental trailers.
1 One Year Warranty is limited to doors, aluminum, plastics or ACM products, plumbing, cabinets, trim, electrical, sealants, improper application of paint, clear coat or powder coat, and lights. Aftermarket products installed or applied by Sojourn Overland are excluded from this warranty, but may be warranted by the applicable supplier. and
2. The Welded Tubular Trailer Frame Chassis and associated rack components will for a period of twenty four (24) months following the Owner’s purchase of the Trailer from the Manufacturer (the “Frame Warranty Period”), be free from defects in material or workmanship and will conform to all written specifications provided by the Manufacturer.
(The above warranty referred to herein as the “Warranty”).
Terms and Conditions of Warranty
1. The Warranty becomes effective once the trailer is bought, paid for and picked up by the Owner.
2. The Warranty is the only warranty on the part of the Manufacturer and there is no other representations or warranties, express or implied, other than as expressly set forth or referred to herein and, without limiting the generality of the foregoing, the Manufacturer does not make any warranties to the owner or to any other person or entity, whether express, implied or statutory, as to the description, quality, merchantability, completeness or fitness for any purpose of the Trailer or information provided hereunder or described herein, or as to any other matter all of which warranties are hereby excluded and specifically disclaimed.
3. The Warranty does not apply to any Non-Warranty Components. The Manufacturer is not the manufacturer of the following products: water pump, water tank(s), corner steadies, jockey wheel, electrical components, axles, RV side doors, tires, rims, batteries, aluminum tool boxes, coolers or other additional optional items purchased from the Manufacturer. The Manufacturer has not conducted any independent tests for Non-Warranty Component’s quality and fitness and makes no expressed or implied representation or warranty regarding their freedom from defects.
4. If any defects in material or workmanship are discovered during the applicable Warranty Period, the Manufacturer will, at its sole discretion, repair or replace the defective component.
5. Any defects must be brought to the attention of the Manufacturer no later than thirty (30) days after the discovery of such. Photos and a description of such must be provided via e-mail and a phone conversation must also take place within those thirty (30) days.
6. The Warranty is effective only for the applicable Warranty Period and only in respect of any defects reported to the manufacturer discovered during the applicable Warranty Period. The Warranty does not apply to the cost of transporting materials or units to or from the repair site.
7. The Warranty applies only to new Trailers operated in the ordinary course and in accordance with the Manufacturer’s specifications and guidelines (as may be modified or amended from time to time). The Warranty will be void and of no effect if (a) any after-market modifications are made to the Trailer, (b) any repairs are made to the Trailer using non-authorized parts, (c) the Owner fails to maintain the Trailer in a reasonable manner; or (d) in the opinion of the manufacturer, damage has occurred because of misuse, acts of God, negligence, or other causes beyond control of the Manufacturer.
8. As used herein, the following terms have the meanings given thereto: a. “Non-Warranty Components” means any part, product or component included with or affixed to the Trailer which are (I) consumables, (ii) are not manufactured by the Manufacturer, or (iii) are covered by separate warranties of the individual manufacturer of such component : (water pump, water tank(s), corner steadies, jockey wheel, electrical components, axles, RV side doors, tires, rims, batteries, aluminum tool boxes, coolers or other additional optional items purchased from the Manufacturer). b. “Owner” means the original purchaser of the Trailer from the Manufacturer and excludes any person which has purchased the Trailer from a person other than the Manufacturer. c. “Trailer Components” means any part, product or component of the Trailer excluding the Trailer Frame and the Non-Warranty Components. d. “Tubular Trailer Frame Chassis” means the lower chassis frame of the Trailer, excluding any Non-Warranty Components. e. “Warranty Period” means either the Component Warranty Period or the Frame Warranty Period, as applicable.
The Warranty is in substitution for and eliminates all other liabilities of any kind whether arising under statute, in tort, by implication of law or otherwise, including, to the full extent as may be allowed by law, liability for any other representations respecting the Trailer, statutory warranties or implied warranties or conditions as to the Trailer’s merchantability or fitness. The Manufacturer’s sole liability for a breach of the Warranty, and the Owner’s sole remedy, shall be the repair or replacement of the defective component, as applicable. Under no circumstances shall the Manufacturer be accountable to any person for loss or damage to the Trailer or its parts, loss of time, inconvenience, business loss, consequential or other damages or any other claims associated to or amounting from any defect in factory materials or workmanship whenever found except as provided for herein.
WARRANTY COMMENCEMENT
Warranty shall commence on the date that the first retail owner (original purchaser) takes possession of the trailer and removes said trailer from the Sojourn Overland manufacturing facility located in Lacombe County, Alberta, Canada.
ACTION REQUIRED IN THE EVENT OF A DEFECT
For Warranty coverage, you must immediately contact Sojourn Overland from which your unit was purchased to make a warranty claim. Some parts or accessories may need to be replaced by third party suppliers, and in some cases the defective part may need to be returned for reimbursement or inspection. Prior to warranty repairs, Sojourn Overland must verify unit number, purchase date, and original ownership. You must pay all incidental expenses incurred in obtaining warranty service, including, without limitation, transportation of the trailer and delivery charges to and from Sojourn Overland or an authorized repair center upon being pre-approved by Sojourn Overland.
If the trailer is found to be defective in materials or workmanship, all repairs must be performed by Sojourn Overland or an authorized repair center. All warranty work performed must be pre-approved by Sojourn Overland, or Sojourn Overland reserves the right to deny coverage. Sojourn Overland is not responsible for costs relating to transportation of the affected trailer or responsible for damages to goods stored inside of the trailer. Sojourn Overland’s obligations under this warranty shall be limited to repairing or replacing any part or parts which, in the opinion of Sojourn Overland, shall prove defective in materials or workmanship under normal use and service during the applicable two or one year period commencing with the date of the first retail purchase and no other remedy is available.
WHAT IS NOT COVERED – THIS WARRANTY SHALL NOT APPLY TO:
Routine maintenance including, without limitation, caulking, re-caulking and cleaning of the body of the trailer, tightening screws, brake squeak/lock-up/adjustment, greasing of wheel bearings, latches, locks, changing fuses and general maintenance;
Adjustments to all doors, drawers, locks, latches, beyond 90 days after retail sale.
Equipment, products, components, appliances, or accessories not manufactured by Sojourn Overland;
The Trailer being used for business, rental, commercial, residential, or disaster relief purposes, or any purposes other than recreational travel and family camping;
The Trailer not originally purchased through Sojourn Overland or those purchased through auction, repossession, salvage or an otherwise damaged or distressed condition;
Damage or loss caused in whole or in part by the misuse, abuse, neglect, theft, vandalism, product modification, improper customer or dealer installation, improper stowing of equipment, overloading or improper balancing of the load, overloading or misuse of cooler rollout drawer or kitchen rollout drawer, low or high voltage, unauthorized repair or failure to follow instructions supplied with the trailer;
Damage or loss caused in whole or in part by the unauthorized attachments, modifications or alterations to the structure, body, 7 pin electrical connector, or frame of the trailer including but not limited to trailer hitches for towing;
Any fading or oxidization of exterior finishes;
Design defects; Redesign/Re-construction of any part of the Trailer; or anything related to wheel or axle alignment;
Rust or corrosion due to the environment;
Damage, scratches, scuffs, dents or deterioration due to normal wear and tear, salt, road grime, application of or exposure to corrosive chemicals or other corrosive materials (including without limitation magnesium chloride or calcium chloride), or arising from an accident or use of the trailer. Sojourn Overland reserves the right to test individual parts for magnesium and calcium chloride exposure; these materials are extremely corrosive to all metals and damages arising from exposure to them is not covered by this warranty;
Defects arising from operator’s negligence, misuse, abuse, loading the unit beyond its gross weight limitations, improper loading, accidents, acts of God, roof damage from excessive snow/ice buildup, or other contingencies beyond the control of Sojourn Overland;
Damage or loss caused in whole or in part by animals, exposure to natural or atmospheric elements, corrosive chemicals, ash or fumes generated or released by vehicles, collision, road hazards, rock chips, condensation, or any other source;
Repairs made necessary by reason of repairs or alterations or installation of aftermarket accessories not performed by Sojourn Overland. Any leaks caused by modifications made to the trailer not performed by Sojourn Overland.
Damage caused by failure to check / re-torque wheel lug nuts;
Damage or loss caused in whole or in part by the willful or negligent acts of the driver of the vehicle pulling the Trailer, an accident involving the Trailer, or the condition of any road surface;
Damage or loss to the Trailer caused in whole or in part by the tow vehicle selected by the owner, owner’s operation or use of the tow vehicle, improper selection or installation of towing hitch on tow vehicle, weight distribution, sway control or equalizer equipment, or damage to the owner’s tow vehicle;
Any injury, loss or damage due to mold or fungi; and
Any Trailer licensed, registered, or primarily used outside Canada or the USA.
The Sojourn Overland warranty period is valid from the date of purchase by the first retail owner and is not transferrable.
THIRD PARTY PARTS, PRODUCTS AND COMPONENTS
While Sojourn Overland does not warranty third party parts, products and components, Sojourn Overland will facilitate the handling of such warranties either through direct facilitation or directing the customer to the proper place to handle such warranty claims. Items that fall under this category:
- Treeline Outdoors RTT and Annex room (2 year warranty)
- Timbren Axles (3 year warranty)
- BF Goodrich Tires (see tire manufacture for warranty)
- Darche Products (2 year warranty)
- Buyers Products Tool Boxes (1 Year Warranty)
- Ark Products jockey wheel and corner steadies (1 Year Warranty)
- Max coupler (1 Year Warranty)
No dealer, distributor, agent, representative of Sojourn Overland, or other person is authorized to make any representation or a promise of warranty concerning Sojourn Overland’s trailers on behalf of Sojourn Overland except to refer the purchaser to this Limited Warranty.
All warranty claims must be made within the warranty period. All warranty claims must be submitted to Sojourn Overland via e-mail and phone call.Sojourn Overland reserves the right to change any components used in production at their discretion.
